The Ninth Circuit Court of Appeals today released an order in BARAJAS v. WISE, No. 06-15494, a habeas corpus appeal. The panel consisted of Myron H. Bright, Dorothy W. Nelson, and Marsha S. Berzon, Circuit Judges.

The petition for panel rehearing is GRANTED. The opinion filed March 23, 2007, slip op. 3449, and published at 481 F.3d 734 (9th Cir. 2007) is hereby vacated. The case has been resolved in an unpublished memorandum disposition. The petition for rehearing en banc is DENIED as moot. *The Honorable Myron H.
